Attorneys Cavacini and Ralston Convince Superior Court that Billboard Is Permitted
Attorneys Victor Cavacini, with help from Attorney Andy Ralston, recently received word that they were sucessful in convincing the Superior Court of Pennsylvania that a local landowner should be permitted to erect a billboard on one of the lots on his property.  The landowner, located along Route 222, argued to both the local Zoning Hearing Board, and the Court of Common Pleas, that a billboard was a permitted use on his property.  The ZHB and local court found that he could not, supposedly because he was, among other reasons, already using the lot in question for another purpose:  as a "detention area" for rainwater.  Gross McGinley argued that a "detention area" is not a "use" under the local zoning ordinance and that restricting a property owner's use of a lot to only a "detention area" for rainwater is unconstitutional.  The Superior Court agreed.
